Hi,
I work for an Indian based major IT company and they have deputed me to US to work for their clients .They don’t pay for health insurance but instead they deduct the money from the employee salary and pay to the insurance company.For my wife they had been deducting money from my salary but they didn’t ever pay the premium to the insurance company for 3months .My wife fell ill but couldn’t go to a doctor as the insurance wouldn’t cover .I raised the bells at the doors of my employer but their deaf ears couldn’t hear my helplessness.
Ultimately they asked the insurance company to include my wife on the plan.But for the prior 3 months the premium deducted from my salary was never paid back to me. Also because of being unable to take her to a doctor her disease went severe .Can I sue my company because of this mistreatment ? Will I bee able to win ? Any attorney suggestions,

  2. IF your wife lived in the US, and you were living in the US, and it was a US plan, you could sue for the uninsured claims in a US court – and you would win, based on the facts you outlined above.

    I have NO idea what the laws are in India, however, so if she lives there, you’re going to have to consult someone in India about employers obligations.

  3. YES. of course you can sue. I don’t kno what laws are in INdia but over here. You have a very strong case.
